Georgia Negligent Security Law
In Georgia, negligent security refers to situations where property managers or owners fail to take reasonable steps to ensure the safety of their premises, often leading to harm for individuals on the property. This can include a range of issues, such as poor lighting in parking areas, broken door locks left unrepaired, or insufficient staffing to provide adequate surveillance.
When safety measures are neglected, everyone is put at risk. Property owners have a legal obligation to protect their residents, especially in areas where criminal activity is a known threat. By law, landlords must implement adequate security measures to prevent and reduce incidents of violence within their complexes. These measures may include visible, functioning security cameras, on-site security guards, access-controlled gates, perimeter fencing, or guard stations at parking garages or entry points.
A History of Crime at the Flint Ridge Apartments
The Flint Ridge Apartments opened in 2022 and are located near Albany State University. Tragically, the area on and around the university campus is frequently the site of reported shootings including this recent mass shooting at a homecoming event. In 2014, a shooting homicide took place at the Wild Pines apartments, which is also near Albany State University. In 2019 there was a shooting that injured two men at the same apartment complex.
Only Crime Victims or Their Relatives Can Demand Justice
In Georgia, apartment owners are legally obligated to take specific steps to safeguard their properties against criminal activity. While law enforcement officers are responsible for apprehending offenders and ensuring they face justice, their role does not include requiring property owners to implement additional safety measures or compensating victims.
It falls to crime victims or their families to pursue legal action against property owners for any negligence. Compensation awarded through such lawsuits can help cover medical expenses and lost income, but it’s important to note that financial compensation alone cannot fully address the emotional trauma victims suffer from these distressing incidents.
However, substantial financial compensation could incentivize property owners and managers to improve security measures, potentially deterring future crimes. This not only helps protect the community but also reinforces the importance of accountability in maintaining a safe environment for residents and visitors.
Together we can Make Georgia Safe, one community at a time.
