Georgia Negligent Security Law
Negligent security occurs when property owners or managers fail to take reasonable steps to ensure the safety of their premises. This negligence can leave residents and visitors vulnerable to harm, including violent crime. Common examples of negligent security include:
- Poorly lit parking lots.
- Broken door locks or security gates left unrepaired.
- Inadequate or absent security staff.
When basic safety measures are overlooked, the consequences can be devastating. Georgia law holds property owners accountable, particularly in areas with a history of criminal activity. Landlords and property managers are required to implement effective security measures to help prevent violence, such as:
- Functional security cameras.
- On-site security personnel.
- Controlled access through gates or keypads.
- Perimeter fencing to protect residents.
- Guard stations at entrances or parking garages.
Every family deserves to feel safe in their home and community. When property owners fail to meet their legal obligations, they place lives at risk. Holding them accountable not only seeks justice for victims but also prevents future tragedies.
A History of Crime at the Liberty Commons Apartments
Online reviews paint a picture of a once decent apartment complex that has fallen in quality and safety in recent years. One resident notes that things have gone downhill since “they fired the security guard.”
Another resident warns in their review, “if you want to witness crimes move in this complex.”
In November 2023, a 19-year-old man was shot and injured at the entrance to the Liberty Commons apartments. In 2023 a 4-year-old was killed in a shooting at the apartment complex. In September 2017, a woman was robbed while living at the complex.
Only Crime Victims or Their Relatives Can Demand Justice
In Georgia, apartment owners are legally required to take proactive steps to protect their properties from criminal activity. While law enforcement focuses on apprehending offenders, it is not their role to compel property owners to enhance safety measures or provide compensation to victims.
For victims of violent crime and their families, seeking justice often involves pursuing legal action against negligent property owners. Financial compensation from such lawsuits can help cover medical expenses and lost income, but no amount of money can fully heal the emotional trauma caused by these devastating events.
Importantly, holding property owners accountable through substantial compensation can lead to improved security measures that not only help prevent future crimes but also foster safer communities and demonstrate the importance of responsibility in protecting residents and visitors.
Together we can Make Georgia Safe, one community at a time.
