Georgia Negligent Security Law

In Georgia, negligent security refers to situations where a property manager or owner fails to take reasonable steps to ensure the safety of the premises, which could result in harm to individuals on the property. This can include a range of issues, such as poor lighting in parking areas, broken door locks that aren’t promptly fixed, or not having enough staff to provide proper surveillance and oversight.

When these safety measures are neglected, it puts everyone at risk. Property owners have a legal obligation to ensure the safety of their residents, especially in areas where criminal activity is likely to occur. By law, landlords are required to implement adequate security measures to help prevent and reduce incidents of violence within their apartment complexes. These might consist of functioning and visible security cameras, on-site security guards, a perimeter fence with access-controlled gates, or even a guard station at the parking garage or entrance gate.

A History of Crime at the Grove Park Apartments

The apartment complex had experienced crime in the past. In 2017, a series of car break-ins was reported. In 2022, a woman was shot and killed at the apartment complex.

Only Crime Victims or Their Relatives Can Demand Justice

In Georgia, apartment owners are legally obligated to take specific steps to safeguard their properties against criminal activity. While law enforcement officers have the authority to apprehend offenders and ensure they face justice in the courts, their role does not extend to requiring property owners to implement additional safety measures or provide financial compensation to victims.

It falls upon the crime victims or their families to take legal action against the property owners. Any compensation awarded can assist in covering medical expenses and lost income due to an inability to work. However, it’s important to recognize that while this compensation can provide some financial relief, it cannot fully heal the emotional trauma that victims endure from these distressing incidents.

A substantial financial compensation package for victims could incentivize property owners and managers to improve security measures, deterring future crimes. This approach not only safeguards the community but also emphasizes the importance of accountability in maintaining a safe environment for all residents and their visitors.
