Applying Negligent Security Laws in Georgia

In Georgia, property owners and apartment management have an established legal obligation to provide a reasonably safe environment for tenants, employees, and visitors. When they fail to take proper security measures to prevent foreseeable dangers, they may be held liable under the state’s negligent security laws.

Negligent security occurs when property owners disregard basic safety precautions, such as installing proper lighting, securing entrances and exits, or providing security personnel when necessary. If their inaction creates an environment where crime is more likely to occur, they can be held responsible for the harm that results.

By implementing proper security measures to address known safety risks, property owners can significantly reduce the chances of criminal activity. Ignoring these responsibilities not only increases the likelihood of crime, but also exposes property owners to legal consequences for their negligence.

Chronic Criminal Activity and Persistent Gun Violence at South Fulton Apartment Complex

According to research conducted by the Atlanta Journal-Constitution, Freedom Park apartments have been the site of perpetual criminal activity/shootings since at least 2017. “Of note: From 2017-2020, police received 65 reports of a weapon being fired.” Formerly known as Hickory Park, this complex has faced previous lawsuits dealing with ineffective security, health violations, and safety issues.

In October 2021, a shooting on property injured six individuals. In September 2020, a man was critically injured after being shot. Earlier that same year, in June 2020, reports of a homicide took place on property. A year prior, in April 2019, a homicide left three people injured, including a 1-year-old child. In fact, from July 2018 through July 2023, police have reported a total of at least 107 serious crimes.

Online Reviews only serve to confirm the perpetual violence and criminal activity on property. One reviewer writes “this place is hell on earth…I mentally checked out after they killed my neighbor.” Another review reveals a resident was almost shot and that security is rarely out on grounds. “These apartments stay on the news for shootings and people being killed.” Yet another individual writes “it’s a terrible place to stay and you are not protected…there’s fights and shot (sic) outs every night…

Demand the Justice Victims Deserve

When violent crimes occur due to negligent security, victims are often left to deal with devastating physical, emotional, and financial consequences. Law enforcement may investigate the crime, but their role does not extend to holding property owners accountable for failing to provide a safe environment. That responsibility falls to the victim and/or their families, who can take legal action to demand justice.

Pursuing a civil claim against a negligent property owner can provide crucial financial relief for victims, helping them recover from unexpected medical expenses, lost wages, or pain and suffering. While no amount of money can erase the trauma, seeking justice through the legal system can offer a sense of closure and accountability.

Beyond individual compensation, legal action sends a powerful message that property owners cannot ignore safety concerns without consequences. Holding them accountable encourages stronger security measures, such as better lighting, controlled access points, and effective on-site security, ultimately leading to a safe community. By demanding justice, victims not only fight for their rights, but also help prevent similar tragedies in the future.
